2. THE DATA WE COLLECT ABOUT YOU

  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We require all third parties who process your personal data on our behalf to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers acting as data processors to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

 

6. INTERNATIONAL TRANSFERS

We do not transfer your personal data outside of the UK or EEA unless you request that we put you in contact with a collaborator based outside the UK or EEA.

7.DATA SECURITY 

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. 8. DATA RETENTION

How long will you use my personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

LAWFUL BASIS

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

Recruitment Privacy Policy

Apex Molecular Limited (Apex Molecular, we, our) is a controller in relation to personal information. This means that we are responsible for deciding how we hold and use personal information about you.

This Policy is to inform you how Apex Molecular collects and processes your personal information as part of our recruitment process (whether you are applying to be an employee, worker or contractor), how we hold the data, and your rights relating to your personal information. This Recruitment Privacy Policy supplements and should be read together with our Privacy Policy  and Appropriate Policy Document (which is available on request from info@apexmolecular.com).

Data Protection Principles

We will comply with data protection law and principles, which means that your personal information will be:

  • Used lawfully, fairly and in a transparent way.
  • Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.
  • Relevant to the purposes we have told you about and limited only to those purposes.
  • Accurate and kept up to date.

What information do we collect about you?
In connection with your application for work with us, we may collect, store, and use the following personal information about you:

  • your contact details, including your name, address, telephone number and personal e-mail address;
  • and other personal information (i) included in a CV, any application form, cover letter, or (ii) that you provide to us during any interview process;
  • details of your skills, qualifications, experience and work history with previous employers;

  • information about your right to work in the UK and copies of proof of right to work or identification documentation; and
  • copies of qualification certificates.

We may also collect, store and use the following “special categories” of more sensitive personal information:

  • information about your health, including any medical condition, health and sickness records;
  • information about criminal convictions and offences.

How do we collect the information?
We may collect this personal information from the following sources:

  • you, the candidate;
  • recruitment agencies from which we collect the following categories of data: personal and contact details; education and employment history (CV and covering letter);
  • search consultants;
  • ourselves via Google, or via OSINT searches, or via an employment background check provider hired by us;
  • from checks carried out by the landlord of the building in which Apex leases office space (for more information about this, please see the section below “How will we share the information”);
  • your named referees;
  • disclosure and barring service in respect of criminal convictions; and
  • data from third party publicly accessible sources, for example, UK government right to work checks, Google and via open-source internet mining (OSINT).

 

How will we use your personal information?
We use your personal information to enable us to:

  • assess your application for employment at Apex Molecular (e.g., skills, qualifications and suitability for the relevant role);
  • communicate with you about the recruitment process;
  • carry out background and reference checks;
  • keep relevant records; and
  • comply with legal and regulatory requirements. For example, we are required to check your eligibility to work in the UK before employment starts.

 

We have a legitimate interest in processing personal information during the recruitment process and for keeping records of the process. Processing personal information from you allows us to manage the recruitment process, assess and confirm your suitability for employment and decide to whom we offer a job.

 

It is in our legitimate interests to decide whether to appoint you to the applicable role since it would be beneficial to our business to appoint someone to that role.

We also need to process your personal information to decide whether to enter into a contract with you.

Once we receive your personal information, we will then process that information to decide whether you meet the basic requirements to be shortlisted for the applicable work/role. If you do, we will decide whether your application is strong enough to invite you for an interview.

If we decide to call you for an interview, we will use any information you provide to us at the interview to decide whether to offer you the role.

If we decide to offer you the role, we will then take up references, and depending on the proposed role, we may carry out a criminal record and/or other background checks before confirming your appointment.

We will not use your personal information for any purpose other than the recruitment exercise for which you have applied, unless we have your consent to do so.

How will we share the information?
Your information will be shared internally for the purposes of the recruitment process. This includes members of the HR and recruitment team, interviewers involved in the recruitment process and managers in the business area with a vacancy.

We will not share your data with third parties, unless your application for employment is successful and we make you an offer of employment. We will then contact your nominated referees to obtain references for you, and may carry out employment background checks including a criminal record check.  All our third-party service providers are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.

We will also share your name and contact information with our current landlord (if applicable), in order for a security pass to be issued to you for the site where our offices are based. Prior to issuing you with a security pass, the landlord will carry out a background check, and general search via OSINT using the personal information we shared with them, and any further personal information you provide to them directly. These searches are carried out by the landlord, for the landlord’s security purposes. The landlord acts as an independent controller of the personal information we share with them (and which you directly share with them). We do not have any control over what the landlord does with the information once we share it with them. You should ask the landlord for a copy of their privacy policy for your records. The landlord does not share search results with us, unless there is something specific of note, which may affect our decision to employ you. If the landlord shares any personal information with us resulting from its searches, we will process it in accordance with this policy as an independent controller.

All (i) staff, and (ii) third parties, who process your personal information as data processors on our behalf, in each case who have access to your personal data, are bound by a duty of confidentiality.

We do not transfer the personal information we collect about you outside the UK.

How will we use sensitive personal data?
We may process health information to consider if we need to make reasonable adjustments to the recruitment process for you. This is to carry out our obligations and exercise specific rights in relation to employment.

We may use information about your race or national or ethnic origin, religious, philosophical or moral beliefs, or your sexual life or sexual orientation, to ensure meaningful equal opportunity monitoring and reporting.

We do not envisage that we will process information about criminal convictions, unless we plan to offer you a particular role. If necessary for the role you applied for, we may carry out a criminal records check in order to satisfy ourselves that there is nothing in your criminal convictions history which makes you unsuitable for the role. If you fail to provide personal information

If you fail to provide information when requested, which is necessary for us to consider your application (such as evidence of qualifications or work history), we will not be able to process your application successfully. For example, if we require a credit check or references for a particular role and you fail to provide us with relevant details, we will not be able to take your application further.

 

How is the personal data is stored?
We take all reasonable and appropriate steps to protect the personal information that we hold from misuse, loss or unauthorised access. We have appropriate technical and organisational measures in place for security and controlled access. These include measures to deal with any suspected data breach. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need-to-know for the purposes of your potential recruitment.

How long is personal data retained?
Your personal information is deleted 6 months following notification that you were unsuccessful in your application for the relevant role. We retain your personal information for that period so that we can show, in the event of a legal claim, that we have not discriminated against candidates on prohibited grounds and that we have conducted the recruitment exercise in a fair and transparent way. After this period, we will securely destroy your personal information.

If we wish to retain your personal information on file, on the basis that a further opportunity may arise in future and we may wish to consider you for that, we will write to you separately, seeking your explicit consent to retain your personal information for a fixed period on that basis.

What rights do I have over my data?
Data protection regulations provide that you have certain rights over your personal data. These include, under certain circumstances, right to access data, have data rectified if incorrect, have data deleted, object to processing, request the restriction of processing and request the transfer of your personal information.
